A lawsuit to establish clear ownership and remove competing claims or defects from a property’s title. It’s a common way to resolve stubborn title issues.
It depends on the facts, the title policy, and the closing documents. The Elliot Legal Group can review the title and advise on options.
It depends on the defect. Many resolve with a corrective deed, a recorded release or satisfaction, or an affidavit. Others — competing ownership claims, missing heirs, old unreleased liens — need a quiet title action. If the defect appeared after closing, a title insurance claim may cover the cost of clearing it.
Yes. The firm reviews title commitments and surveys before closing and handles defects and disputes that surface after closing, including quiet title actions and title insurance claims.
No. Coverage depends on the type of policy, the insured interest, and the policy's terms, exclusions and exceptions. A lender's policy protects the lender's interest and does not replace an owner's policy. If a problem appears, preserve the records and check the applicable notice and claim requirements promptly.
