Rarely without consequence. Commercial tenants have far fewer statutory protections than residential ones, and withholding rent can trigger default. Florida law generally requires a commercial tenant contesting rent to deposit it into the court registry to avoid losing possession by default. Get advice before withholding anything.
Commercial leases largely set their own notice terms, unlike residential tenancies where the statute controls. Whatever the lease requires — form, delivery method, cure period — has to be followed precisely. Defective notice is the most common reason a commercial eviction gets dismissed and has to start over.
Some commercial leases permit it, but the risk is significant. Doing it without clear lease authority, or doing it wrong, exposes the landlord to damages and can undermine the eviction. Confirm what the lease actually allows before taking possession of anything.
