If no response is filed in the time the rules allow, the plaintiff can move for a default. A default can become a judgment against you without your side of the facts ever being heard, and setting one aside is difficult. Responding on time is what keeps your defenses available.
An answer responds to each allegation and raises your affirmative defenses. A motion to dismiss asks the court to end the case, or part of it, on legal grounds before an answer is due — for example lack of jurisdiction or failure to state a cause of action. Which one fits depends on the complaint, and the choice affects both timing and cost.

Removal is available in limited circumstances — generally where a claim arises under federal law, or where the parties are citizens of different states and the amount in controversy is met. The deadline is short, usually 30 days from service, which is why it is assessed at the first meeting. Our Managing Attorney is admitted in the Middle and Southern Districts of Florida.
The summons and complaint with all exhibits, whatever the process server left with you showing the date of service, the contract or lease at issue, correspondence with the opposing party, and any insurance policy that might respond. If you have less than that, come anyway — the date of service matters most.
